Transfer of Ownership / Equity

We understand that clients from time to time may wish to transfer the legal ownership of a property from their name to another or from their sole name to them and another party, a spouse or child for example, without any monies or consideration being provided. This is relatively straightforward transaction and can be completed quickly with minimum inconvenience to the parties concerned.

If the property is affected by mortgage, it is merely a case of obtaining the lenders consent and dealing with their requirements. In the main, this will mean obtaining the new parties consent and understanding that they will be, from the time of completion of the transfer, mutually responsible for the mortgage repayments. It will be necessary for all parties to sign a new mortgage deed and transfer deed.

Following completion, we will register the transfer of ownership, known legally as a transfer of equity, at HM Land Registry.
